Judicial Branch |
It is the branch that hears criminal and civil cases. Each citizen is innocent until proven guilty and have the right to a speedy and public trial. The courts are set up with two branches state and federal courts, state courts are to handle matters in the state like small cases like felonies, the federal courts, which is the Supreme Court, handle cases that usually have to do with the constitution.
quick and public
The constitution says that every man has the right to a quick and public trial but this is upon request. If requested and they are not given a speedy trial then the trial can be void if the long wait had harmed the defendants case and if the delays were unreasonable. The right to a public trial is also aloud upon request however if it is a public trial and a large mob is being obnoxious in the court the judge has the right to make it private and kick the mob out.
Double Jeopardy
The Constitution also has no Double Jeopardy meaning you can't be tried for the same crime twice. But their are loopholes for example if the prosecutor couldn't find you guilty on robbing a liquor store but you sold the products you stole then they will charge you with selling without a liquor license. There is also the process of sending the same case to a higher court.
